Cosmetics Stock Lots: Expiry, CDSCO Rules & Label Checks

Category guides: Cosmetics Stock Lots: Expiry, CDSCO Rules & Label Checks

The market for surplus cosmetics, personal care goods, and toiletries in India is fast-growing. Retail chains clear excess seasonal gift packs, manufacturers liquidate discontinued shade variants of lipsticks and foundations, and distributors offload overstocked skincare batches before year-end books close.

However, cosmetics are regulated under the Drugs and Cosmetics Act, 1940, and the Cosmetics Rules, 2020, overseen by the Central Drugs Standard Control Organisation (CDSCO). Trading in personal care products requires strict compliance with labelling, manufacturing licenses, and remaining shelf life.

Before purchasing or liquidating lots in cosmetics and personal care, review these rules to protect your capital and maintain regulatory compliance.

1. Remaining Shelf Life: The 6-Month Liquidation Rule

In consumer FMCG and beauty retail, products are judged by remaining shelf life.

Unlike machinery or steel, beauty formulations, especially water-based creams, sunscreens with active UV filters, and preservative-sensitive serums, break down over time. Emulsions can separate, active ingredients lose efficacy, and fragrance notes oxidize.

Trade Norms for Shelf Life Discounts

Shelf Life RemainingRetailer ViabilityExpected Lot Discount
18 to 24+ MonthsStandard tier-1 retail & e-commerce20% to 35% below distributor price
12 to 18 MonthsRegional supermarkets & beauty counters35% to 50% below distributor price
6 to 12 MonthsDiscount stores, bundle packs, wholesale50% to 70% below MRP
Under 6 MonthsExtreme risk; narrow liquidation window75% to 85% below MRP

If a lot has less than 6 months of shelf life left, you must have an immediate clearance channel lined up, such as regional value bazaars or salon bulk users, before committing funds. Selling cosmetics within 30 days of expiry or past expiry is illegal in India and invites seizure.

2. Mandatory Labelling Requirements under Cosmetics Rules 2020

Under Indian law, every outer pack and immediate container of cosmetic goods must carry specific statutory disclosures. When evaluating an overstock lot, confirm that every unit has original factory printing:

  1. Manufacturing License Number: Form Cos-8 or Form Cos-9 license number (e.g., `Mfg. Lic. No. M-1234/COS/2021`). Unlicensed homemade or white-label cosmetics without registered factory license numbers cannot be legally re-sold.
  2. Batch / Lot Number: Preceded by the letter "B" or "Batch No." Every box must have traceable batch coding matching the master shipping cartons.
  3. Manufacturing & Expiry Dates: Clearly printed as "Mfg Date" and "Use Before" or "Expiry Date". If expiration is calculated from manufacturing (e.g., "Best before 24 months from mfg"), the manufacturing month and year must be legible.
  4. Complete Ingredient List: Ingredients listed in descending order of concentration using International Nomenclature of Cosmetic Ingredients (INCI) names.
  5. Manufacturer / Importer Address: Full name and physical address of the manufacturing unit or the registered Indian importer, accompanied by the CDSCO Import Registration Certificate (Form Cos-2) number for imported brands.

Never buy cosmetic lots where the seller has pasted stickers over the original MRP, scratched off batch numbers, or covered the manufacturer's address. Tampered packaging suggests grey-market smuggling, counterfeit goods, or re-labelled expired stock.

3. Storage and Warehouse Temperature Checks

Cosmetics are sensitive to temperature abuse. Lipsticks melt, creams separate into water and oil phases, and shampoos thin out when exposed to summer temperatures exceeding 42°C in non-insulated tin sheds across North and Central India.

Before releasing payment for a cosmetic stock lot:

  • Inspect Sample Units: Crack open random sample units from the bottom and middle rows of pallets. Smell lotions and creams for rancidity (sour or oily smell indicating degraded fatty acids).
  • Check Colour Consistency: Check nail polishes for excessive sediment separation and lipsticks for sweating (oil droplets forming on the exterior bullet).
  • Physical Carton Condition: Look for water stains or damp-weakened corrugated boxes, which indicate improper humidity control during warehousing.

4. Selling Surplus Cosmetics Legally

If your manufacturing plant or distribution agency holds surplus inventory, liquidating it through B2B channels frees up tied-up working capital. You can sell surplus stock directly to registered wholesalers and salon chains across India.

When listing cosmetic lots, always disclose:

  • Precise batch numbers and expiry dates.
  • Packing condition (factory shrink-wrapped, shelf-ready mono-cartons, or outer master shippers).
  • GST invoice availability with the correct HSN code (typically HSN 3304 for beauty and skincare, 3305 for haircare, and 3307 for deodorants and shaving preparations).

Review our safe trading guidelines to understand how to verify trade partners before dispatching goods.

Questions

Can imported grey-market cosmetics be legally sold in India?

No. All imported cosmetics sold in India require registration with CDSCO under Form Cos-2 and must carry the registered Indian importer's name, address, and registration certificate number on the label. Unregistered imported stock is liable to seizure by regulatory authorities.

What is the GST rate on cosmetics and skincare products?

Most cosmetics, perfumery, skincare lotions, makeup, and hair preparations fall under the 18% GST slab under HSN Chapter 33. Shampoos, conditioners, toothpastes, and personal deodorants also attract 18% GST.

How does Bikwao protect buyers in cosmetic stock deals?

Bikwao provides verified supplier credentials, GST checks, and direct communication between verified business owners. Bikwao does not store inventory or test chemical formulations; buyers should always request batch samples and verify lab reports before completing large bulk deals.
