Operated by Mantra Tech Fusion (Proprietor: Vikrant Saini), GSTIN: 06BLSPS8961E1ZD. This policy defines the legal boundaries of platform operation, statutory safe harbor under Section 79 of the Information Technology Act, 2000, warranties, aggregate liability caps, and user indemnification.

10.0 Intermediary Status & Non-Verification Authority Disclaimer

Bikwao (and its specialized verticals property.bikwao.com, vehicle.bikwao.com, business.bikwao.com, resto.bikwao.com, rentals.bikwao.com, and agri.bikwao.com) operates purely as an online advertising directory and electronic intermediary under Section 79 of the Information Technology Act, 2000.

  • Service Charges for Classified Advertising Only: All fees collected by the Platform are strictly subscription and visibility charges for digital classified advertisement hosting under SAC 998365. Bikwao does not charge brokerage, does not trade in goods, does not inspect or take physical custody of machinery or inventory, and does not hold transaction advance funds or settlement accounts.
  • Zero Statutory Verification Authority: Bikwao is not a government agency, regulatory authority, chartered appraisal bureau, or certified inspection body. Bikwao holds no statutory power or authority to verify, certify, guarantee, or authenticate the legal title, financial solvency, mechanical condition, engine fitness, RERA compliance, or physical quality of any listed item, vehicle, business, or user.
  • Digital Badges Are Not Legal Certifications: Badges such as "Mobile Verified", "Documents Submitted", or "Reviewed by Bikwao" signify solely that basic automated digital steps (such as phone OTP confirmation or document file submission) were performed by the user. They do not constitute a legal endorsement, title certification, solvency audit, or safety warranty.
  • Mandatory Buyer and Seller Due Diligence: All users are strictly required to conduct independent physical on-site inspections, verify registration documents directly on official government portals (such as Parivahan RTO, State RERA websites, GST Search, MCA registry), and execute formal bilateral contracts before paying any advance or token money.

10.1 “As Is” & “As Available” Platform Operation

The Platform, including all Listings, seller profiles, catalog descriptions, and communications, is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular commercial purpose, title, non-infringement, or uninterrupted availability.

10.2 No Liability for User Transactions & Offline Deals

To the maximum extent permitted by applicable Indian law, Mantra Tech Fusion, its directors, officers, employees, agents, and affiliates shall NOT be liable for:

  • The quality, safety, legality, authenticity, material specifications (GSM, weave, alloy purity), or condition of any item or service listed by a User;
  • Any loss, fraud, misrepresentation, breach of contract, or dispute arising from a transaction between a buyer and a seller, whether conducted through the Platform’s payment gateway or offline (cash, direct UPI, or direct bank transfer);
  • Any loss or damage arising from a User’s failure to follow the recommended safety practices in Section 5 (Safety Guidelines);
  • Any indirect, incidental, special, consequential, or punitive damages (including loss of business profits, goodwill, or commercial opportunities) arising from the use of or inability to use the Platform;
  • Any downtime, data loss, server interruption, or technical failure of the Platform, to the extent beyond our reasonable control.

10.3 Aggregate Liability Cap (6 Months Platform Fees)

Where Mantra Tech Fusion is found liable by a court of competent jurisdiction for any claim arising out of or relating to the Platform (including payment-gateway related claims properly attributable to us), our aggregate liability shall not exceed the total platform fees actually paid by the affected User to Mantra Tech Fusion in the six (6) months preceding the event giving rise to the claim, except where such limitation is not permitted by applicable law.

10.4 User Indemnification

You agree to indemnify, defend, and hold harmless Mantra Tech Fusion, its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:

  • Your Listing or catalog content uploaded to Bikwao;
  • Your breach of these Terms, statutory regulations, or third-party intellectual property rights;
  • Any commercial deal, sample dispute, shipment delay, or payment conflict between you and another trade user.

16. Force Majeure

Mantra Tech Fusion shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including acts of God, natural disasters, epidemics, war, terrorism, riots, strikes, government action, nationwide telecommunications failures, or widespread downtime of third-party payment gateways or cloud infrastructure.
