Intermediary Safe-Harbour Declaration (IT Act, 2000)

Bikwao acts solely as an intermediary/facilitator connecting independent buyers and sellers under Section 2(1)(w) of the Information Technology Act, 2000, and is entitled to safe-harbour protections under Section 79 of the Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. In compliance with Rule 3(1)(h) of the IT Rules, 2021, user registration records, access logs, and transaction audit trails are securely retained for a minimum mandatory period of 180 days following account cancellation or withdrawal.

1. Introduction & Acceptance of Terms

Welcome to Bikwao (“Bikwao”, “the Platform”, “we”, “us”, or “our”), an online classifieds and B2B listing marketplace accessible at www.bikwao.com, owned and operated by sole proprietorship firm Mantra Tech Fusion (Proprietor: Vikrant Saini) (“Company”, “Mantra Tech Fusion”), having its registered office at No 26, Indira Colony, Model Town, Panipat, Haryana 132103, India, GSTIN: 06BLSPS8961E1ZD.

These Terms of Use, together with our Privacy Policy, Payment Policy, Refund & Cancellation Policy, Listing & Seller Policy, and Grievance Redressal Policy (collectively, the “Terms” or “Policies”), govern your access to and use of the Platform, whether as a visitor, registered user, buyer, or seller (each a “User”, collectively “Users”).

By accessing, browsing, registering on, or using Bikwao in any way, including posting a listing, contacting another User, or making or receiving a payment through the Platform, you confirm that you have read, understood, and agree to be legally bound by these Terms. If you do not agree with any part of these Terms, you must not use the Platform.

We may update these Terms from time to time to reflect changes in our services, technology, or legal requirements. Continued use of the Platform after any update constitutes your acceptance of the revised Terms.

1.1 Ecosystem & Subdomains

Bikwao operates dedicated service verticals including property.bikwao.com and vehicle.bikwao.com. All transactions, listing charges, inspection/booking tokens, and platform subscriptions across these subdomains are legally billed and processed centrally under Mantra Tech Fusion (bikwao.com), with 18% GST tax invoices issued upon payment confirmation and corresponding GST credit notes generated for eligible refunds.

2. Nature of the Platform

Bikwao is an open online marketplace and classifieds platform that allows any registered User to list products, items, or services for sale (“Listings”) and allows other Users to browse, search, and contact listers to buy those items.

  • Bikwao is NOT the manufacturer, owner, seller, or supplier of any item listed on the Platform, unless a Listing is expressly marked as sold directly by Mantra Tech Fusion.
  • Bikwao does NOT inspect, verify, endorse, or guarantee the accuracy, quality, safety, legality, or genuineness of any Listing, or the identity, conduct, or trustworthiness of any User.
  • Any contract of sale formed as a result of a Listing is strictly between the buyer and the seller. Bikwao is not a party to that contract and assumes no liability arising from it.
  • Bikwao reserves the right, but has no obligation, to monitor, review, moderate, or remove any Listing or User account that violates these Terms or applicable law.

2.1 Non-Verification & Classified Service Fee Notice

You expressly acknowledge and agree that:

  • Bikwao operates exclusively as an online intermediary advertising directory under Section 79 of the IT Act, 2000.
  • Platform fees are charged solely for publishing and promoting digital classified listings under Service Accounting Code 998365.
  • Bikwao has no statutory authority, governmental accreditation, or capability to inspect, verify, certify, or audit the physical condition, legal title, ownership authenticity, or financial standing of any buyer, seller, property, vehicle, or commercial business.
  • You assume 100% responsibility for conducting independent due diligence, physical verification, and official record checks prior to entering into any commercial deal or transferring funds.

3. Eligibility & Account Registration

3.1 Who Can Use Bikwao

You must be at least 18 years old and capable of entering into a legally binding contract under the Indian Contract Act, 1872 to register an account, post a Listing, or transact on the Platform. By registering, you represent and warrant that you meet this requirement.

3.2 Account Accuracy & Security

  • You must provide accurate, current, and complete information when creating your account (name, phone number, email address, and any KYC details we may request).
  • You are solely responsible for maintaining the confidentiality of your login credentials (password/OTP) and for all activity that occurs under your account.
  • You must notify us immediately at info.bikwao@gmail.com if you suspect any unauthorized use of your account.
  • One individual or business entity may not maintain more than one active account unless expressly permitted by us in writing.
  • We reserve the right to suspend or terminate any account that provides false, misleading, or incomplete information.

4. Listing & Seller Policy

As a seller, you are solely and fully responsible for the accuracy, legality, and completeness of every Listing you post, including the title, description, images, price, category, and condition of the item or service. 4.1 Seller Memberships, Invoicing & 7-Day Money-Back Guarantee

Paid seller plans (Monthly, Quarterly, Half-Yearly, Annual, or Multi-Year) are billed in Indian Rupees (INR) and are subject to 18% Goods & Services Tax (GST). A computer-generated GST tax invoice is issued upon payment confirmation.

7-Day Money-Back Guarantee Terms:

  • Eligible within 7 calendar days (168 hours) from payment timestamp.
  • Fair use applies: seller must have contacted fewer than 15 buyer inquiries and closed 0 transactions on the upgraded tier.
  • Refund Timeline: Initiated within 24 hours of request verification; credited to original payment source (card/UPI/bank) within 5–7 business days.
  • Processing Fee Deduction: A non-refundable 2.36% banking gateway charge (2% gateway fee + 18% GST on fee) is deducted, and an official GST Credit Note is issued for the reversal. Full details in our Refund Policy.

5. Disclaimers & Limitation of Liability

The Platform, including all Listings, is provided on an “as is” and “as available” basis without warranties of any kind. Mantra Tech Fusion, its directors, employees, and affiliates shall not be liable for the quality, safety, legality, authenticity, or condition of any listed items, or any dispute arising from a transaction between buyer and seller.

Where Mantra Tech Fusion is found liable for any claim arising out of or relating to the Platform, our aggregate liability shall not exceed the total platform fees actually paid by the affected User to Mantra Tech Fusion in the six (6) months preceding the event giving rise to the claim. 6. Intellectual Property Rights & Takedown Requests

The Bikwao name, logo, website design, software, and all associated intellectual property are the exclusive property of Mantra Tech Fusion. You may not copy, reproduce, modify, or create derivative works from any part of the Platform without our prior written consent.

If you believe that any Listing or content on Bikwao infringes your copyright, trademark, or other intellectual property rights, please send a written takedown notice to info.bikwao@gmail.com in accordance with the Information Technology Act, 2000 and the Copyright Act, 1957.

7. Acceptable Use & User Conduct

While using Bikwao, you agree that you will NOT:

  • Post false, misleading, or fraudulent Listings, reviews, or ratings;
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
  • Use automated means (bots, scrapers) to access or extract data from the Platform without written permission;
  • Upload viruses, malware, or attempt to breach the security or integrity of the Platform;
  • Harass, threaten, defame, or discriminate against any other User;
  • Circumvent, disable, or interfere with security features of the Platform;
  • Use the Platform for any unlawful purpose or in violation of any applicable local, state, national, or international law.

8. Governing Law, Jurisdiction & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Terms or use of the Platform shall be subject to the exclusive jurisdiction of the competent courts at Panipat, Haryana, India.

Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, may be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996, by a sole arbitrator appointed by Mantra Tech Fusion. The seat and venue of arbitration shall be Panipat, Haryana, India, and the proceedings shall be conducted in English.

9. Consumer Protection (E-Commerce) Compliance

As a marketplace entity under the Consumer Protection (E-Commerce) Rules, 2020, Mantra Tech Fusion displays seller details against listings, maintains fair pricing, and operates a 24-hour grievance redressal channel. See our Consumer Protection Compliance Policy.

Seller identity documents

Everyone who lists on Bikwao, on bikwao.com or on any Bikwao portal (agri, business, property, rentals, resto and vehicle), on a free or a paid plan, uploads one personal or business document once, before the first listing goes live. The same document covers later listings made with the same mobile number.

Accepted documents: masked Aadhaar (only the last 4 digits visible; a full Aadhaar number is not accepted), PAN card, voter ID, driving licence, passport, Udyam certificate, shop or trade licence, GST certificate, FSSAI licence, company or LLP certificate, partnership deed, or another official document in the seller's or the business's name. A GST registration is never required to list.

Why we ask for it: Bikwao (operated by Mantra Tech Fusion) is an intermediary under Section 79 of the Information Technology Act, 2000. The document is a record of who placed each listing. We use it to deal with complaints and fraud, to settle disputes, to respond to lawful requests from courts and government agencies, and to meet our duties under the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. We do not check documents through any government service, and having a document on file is not an endorsement of the seller or the listing.

How it is kept:

  • Files are encrypted (AES-256) and stored outside the public website. They are never shown to buyers or other users.
  • Photos are saved in WebP format. Of the document number we keep only the last 4 characters.
  • Only the Bikwao super administrator can open a document, and every opening is recorded with the date and time.
  • When you tick the consent box we record the date, time, IP address and the version of the consent text you accepted.

Replace, not delete: you can upload a newer document at any time, for example when it expires or your business details change. Earlier documents are kept, encrypted, as part of the record and are not deleted on request while they may be needed for the purposes above. We keep documents while your account or listings exist and after that for as long as the law requires or a legal claim may arise, and in any case for at least 180 days after the account is closed.

Sharing: we never sell documents or use them for marketing. We share them only when the law requires it, such as an order of a court or a lawful request from a government agency or the police.

Your rights under the Digital Personal Data Protection Act, 2023: you can ask what we hold about you and correct it by uploading a newer document. For questions or complaints write to our Grievance Officer at info.bikwao@gmail.com.
